Implikasi Hukum Terhadap Konflik Tanah Pertanian dan Dampaknya pada Swasembada Pangan di Sulawesi Selatan

Urgensi penelitian ini terletak pada tingginya angka konflik tanah yang terjadi di Sulawesi Selatan, yang tercatat mencapai 37 kasus pada tahun 2024, dengan sektor perkebunan menjadi yang dominan. Konflik ini tidak hanya mengancam kestabilan sosial, tetapi juga berpotensi mengganggu keberlanjutan swasembada pangan di wilayah tersebut, mengingat pentingnya akses dan kepemilikan lahan pertanian. Penelitian ini bertujuan untuk mengidentifikasi faktor penyebab konflik, efektivitas penegakan hukum, dan dampaknya terhadap swasembada pangan. Hasil dari penelitian ini diharapkan dapat memberikan solusi hukum yang komprehensif untuk menyelesaikan sengketa tanah pertanian secara adil dan mendukung program swasembada pangan di Sulawesi Selatan. Metode penelitian ini menggunakan pendekatan kualitatif deskriptif analitis. Data dikumpulkan melalui wawancara, dokumentasi, observasi, dan Focus Group Discussion (FGD), kemudian dianalisis menggunakan NVivo 12 Plus dengan tahapan impor data, coding, visualisasi, dan validasi triangulasi sumber untuk memastikan keakuratan dan kredibilitas hasil penelitian. Temuan penelitian menunjukkan bahwa konflik tanah pertanian di Sulawesi Selatan merupakan masalah multidimensional yang dipicu oleh tumpang tindih kepemilikan, perubahan peruntukan lahan, ekspansi industri dan perkebunan, ketidakjelasan regulasi, serta perbedaan kepentingan sosial-ekonomi, yang berdampak pada ketidakpastian hukum bagi petani, penurunan produktivitas pangan, alih fungsi lahan, dan gangguan rantai pasok. Penegakan hukum yang lemah, kapasitas aparat terbatas, mekanisme sengketa yang kompleks, dan integrasi data yang kurang memadai menjadi penghambat utama penyelesaian konflik. Oleh karena itu, diperlukan pendekatan hukum komprehensif dan kolaboratif, termasuk kepastian regulasi, mekanisme mediasi dan rekonsiliasi inklusif, penguatan kapasitas aparat, serta pemanfaatan data terpadu, dengan sinergi antara pemerintah, aparat hukum, masyarakat tani, dan lembaga non-pemerintah untuk memastikan solusi yang adil, berkelanjutan, dan mendukung tercapainya swasembada pangan.
